Frequently asked questions
Why are rent agreements usually 11 months? +
An agreement of 12 months or more must be registered under the Registration Act, 1908. Keeping it to 11 months with a renewal option avoids mandatory registration in most states — though Maharashtra is an exception (see below).
Do I need to register the agreement? +
Registration is required for tenancies of 12 months or more. In Maharashtra, every leave and licence agreement must be registered regardless of length. Below 12 months elsewhere, registration is usually optional.
What about stamp paper and stamp duty? +
A rental agreement should be printed on stamp paper of the correct value — commonly around 2% of the annual rent, though it varies by state. Get the current rate for your state before printing.
Is a notarised agreement enough? +
Notarisation only attests the signatures. Where registration is required, notarisation alone is not a substitute — you still need to register with the sub-registrar.
Is this agreement legally valid? +
